2.2 Specific deliverables and timelines will be outlined in a project agreement or scope document.
3. Fees and Payment
3.1 A deposit of 30% to 50% of the total project fee is required before work begins.
3.2 Remaining payments must be made according to the agreed schedule.
3.3 Hosting and maintenance fees are billed yearly in advance.
3.4 Failure to pay invoices on time may result in suspension of services.
4. Client Responsibilities
4.1 You must provide all required content, materials, and information in a timely manner.
4.2 You are responsible for ensuring that all provided materials comply with applicable laws, including copyright and data protection.
5. Intellectual Property
5.1 Ownership of the website design will transfer to you upon full payment.
5.2 We retain the right to use the work for promotional purposes in our portfolio unless otherwise agreed.
5.3 Hosting services remain our intellectual property and are non-transferable.
6. Hosting and Maintenance
6.1 Hosting services include backups.
6.2 We are not liable for third-party server outages or disruptions.
6.3 Maintenance agreements cover updates and minor fixes but exclude major redesigns or additional features.
6.4 Compliance with the Law
All customers using our hosting services must ensure their websites comply with applicable laws, including but not limited to those regarding copyright, data protection, and prohibited content. We reserve the right to suspend or terminate hosting services if a website is found to violate any applicable laws or regulations.
7. Digital Marketing, SEO, and Advertising Services
7.1 We provide digital marketing, search engine optimization (SEO), and advertising services to improve your website’s visibility and performance. While we employ industry-standard practices to achieve optimal results, we cannot guarantee specific outcomes such as first-page rankings or a set return on investment.
7.2 It is your responsibility to ensure that any claims, products, or services promoted through your website or advertising campaigns comply with all applicable laws and regulations, including those related to advertising standards and consumer protection.
7.3 Payments for digital marketing and ad space services are non-refundable once campaigns or services have commenced.
7.4 We reserve the right to suspend or terminate services if the content promoted violates laws, contains misleading claims, or breaches our acceptable use policy.
8. Revisions and Approval
8.1 You are entitled to 3 rounds of revisions as specified in the project scope.
8.2 Additional revisions will incur additional fees.
8.3 Final approval is required in writing before the website goes live.
9. Limitation of Liability
9.1 We are not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the website.
9.2 Our liability is limited to the amount paid by you for the specific service in question.
10. Termination
10.1 Either party may terminate the agreement with 30 days’ written notice.
10.2 If you terminate the project early, you will be invoiced for completed work and any applicable cancellation fees.
11. Data Protection
11.1 We will process personal data in accordance with applicable data protection laws, including the UK GDPR and Data Protection Act 2018.
11.2 You are responsible for ensuring your website complies with all privacy regulations, including obtaining consent for cookies.
12. Governing Law
12.1 These Terms and Conditions are governed by the laws of England and Wales.
12.2 Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Amendments
13.1 We reserve the right to amend these Terms and Conditions at any time.
13.2 Changes will be communicated in writing and apply to new services or projects.
